The judge for the initial court case filed by Metcalf has dismissed the appeal .
While this appears to be a major victory for us, our town attorney has indicated that it's extremely likely that Metcalf will take a different route to have the 65 day rule upheld. We expect a new lawsuit will be filed. Consider this an extension to the court battle.
